These terms apply when you start a free trial or take out a DESHANK subscription. They form part of our Terms of Use. If anything in this section conflicts with the rest of the Terms of Use, this section applies to your trial or subscription. Nothing in these terms affects your legal rights as a consumer.
2.1 The subscription and price
- DESHANK is a paid subscription service, and there is no free tier. New users can try it free for 14 days first (see section 2.3).
- Price: £12.99 per month, payable monthly in advance. Whizzly Ltd is not VAT registered, so no VAT is added and £12.99 is the total price. There are no other charges.
- Monthly only – no long contracts. There is no annual plan or minimum term. Your subscription runs month to month until you cancel.
- Your subscription gives you full access to the Service for as long as it is active. [CONFIRM: number of player profiles / devices / household members covered.]
- You must be 18 or over and live in [the United Kingdom – CONFIRM TERRITORIES] to start a trial or subscription. You may let members of your household aged 13 to 17 use the Service under your account with your permission, and children under 13 only under your supervision. You are responsible for their use.
- You will need a DESHANK account (email address) to start a trial and to manage your subscription. [DEVELOPER TO CONFIRM ACCOUNT DESIGN.] Keep your login details secure.
- Payments are processed by Stripe (Stripe Payments UK Ltd and/or Stripe Payments Europe Ltd, depending on our Stripe account [CONFIRM ENTITY]). We never see or store your full card number. Stripe may apply its own terms to the payment.
2.2 Free trial – no card needed
- No payment details are needed to start your free trial, and you will not be charged anything for it.
- Length: 14 days, starting on the day you sign up (day 1) and ending at 23:59 UK time on day 14.
- At the end of the trial, your access pauses. Nothing is charged, and the trial does not turn into a paid subscription automatically. You do not need to cancel anything.
- Your data stays put. Your player profiles and swing history stay in your browser on your device while access is paused (unless you delete them or clear your browser data), and they will be there if you subscribe.
- Reminder: we will email you about [3] days before your trial ends. The email will remind you that nothing will be charged and explain how to subscribe if you want to keep going.
- One free trial per person. Each person, account and household may only have one free trial. If we reasonably believe someone is trying to get more than one trial, we may refuse a trial. You can still subscribe.
- You can close your trial account at any time (see section 2.5).
2.3 Subscribing
- You can subscribe at any time – during your trial, when it ends, or later – by adding your payment details and confirming at checkout (see section 2.12).
- Your paid subscription starts straight away, once you have confirmed you want it to (see section 2.6), and your first payment of £12.99 is taken on that day. If you subscribe during your trial, any trial days you have left will end when your paid subscription starts. [DECISION: alternatively, let the paid subscription start the day after the trial ends.]
- Before you pay, the checkout page will clearly show:
- the price (£12.99 per month) and that no VAT is added;
- that your first payment is taken today, and then monthly;
- that the subscription renews automatically every month until you cancel;
- how to cancel, and your cancellation rights; and
- a link to these terms, which you can save or print.
- The button you press will make clear that you are agreeing to pay. After you subscribe, we will email you confirmation of these details and a copy of these terms, or a link to them. Our contract for the paid subscription is formed when we send that confirmation.
2.4 Billing and automatic renewal
- Your subscription is charged monthly in advance. The first payment is taken on the day you subscribe, and then on the same day each month (or the last day of the month, if that day doesn’t exist).
- Your subscription renews automatically each month at the then-current price, and we will charge your payment method on each billing date until you cancel.
- We will send you a receipt by email after each payment. You can see your billing date and payment history in your account or in the Stripe-hosted billing portal linked from your account [CONFIRM].
- Keep your payment details up to date in your account.
2.5 How to cancel – quickly and online
- Free trial: there is nothing to cancel, because you will not be charged. If you want, you can close your account in your account settings or by emailing hello@deshank.com.
- Paid subscription: you can cancel at any time, online, in your account settings under “Cancel subscription” (which opens the Stripe-hosted billing portal, if used) [CONFIRM]. It takes a few clicks. You do not need to phone us or give a reason. You can also cancel by emailing hello@deshank.com from the email address on your account.
- We will confirm your cancellation by email straight away.
- When you cancel, your subscription will stop at the end of the month you have already paid for. You keep access until then, and you will not be charged again. Except where section 2.6, 2.7 or 2.10 applies, we do not refund part-months.
- Deleting the app, clearing your browser or not using DESHANK does not cancel your subscription. Please cancel using one of the methods above.
2.6 Your 14-day legal right to cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have 14 days from the day a contract is formed to cancel, without giving a reason.
- Free trial: the trial is free and ends automatically, so cancelling it has no cost and you do not need to do anything.
- Paid subscription: DESHANK is digital content that is supplied immediately. When you subscribe, we will ask you to expressly request that your paid access starts straight away, and to acknowledge that you will lose your 14-day right to cancel once it starts. If you do not give that request and acknowledgement, we cannot start your paid access until the 14-day period has ended.
- Monthly renewals: under the 2013 Regulations, automatic monthly renewals do not start a new 14-day cancellation period. This is separate from the new rules in section 2.7.
- How to cancel under this right (where it applies): use “Cancel subscription”, email us, or send us a clear statement, for example using the model form below. We will refund any payment due under this right within 14 days, using the same payment method.
Model cancellation form (complete and return only if you wish to cancel):
To: Whizzly Ltd (trading as DESHANK Golfing Coach), Starkie Chambers, Lancaster Road, Preston, Lancashire, PR1 1DA, hello@deshank.com
I hereby give notice that I cancel my contract for the supply of the following digital content: DESHANK subscription.
Ordered on: [date] · Name: [name] · Account email: [email] · Date: [date]
[SOLICITOR NOTE: confirm whether a web-app subscription is best classed as “digital content” (where the express request and acknowledgement end the cancellation right once access starts) or as a “service” (where the consumer keeps the right for 14 days but pays a proportionate amount for any use). Adjust section 2.6 and the checkout wording to match.]
2.7 New UK subscription rules (Digital Markets, Competition and Consumers Act 2024)
The Digital Markets, Competition and Consumers Act 2024 introduces a new regime for subscription contracts. As at [15 October 2026], this regime is not yet in force. The Government has said it expects it to start in January 2027, but this depends on secondary legislation and guidance from the Competition and Markets Authority, which have not yet been finalised.
Free trial: our trial needs no payment details and never turns into a paid subscription automatically. So we expect the regime’s rules on trials that convert automatically into paid subscriptions (trial-ending reminders and the cooling-off period after conversion) will generally not be triggered by the trial. We will still send the trial reminder described in section 2.2.
Paid subscription: your paid subscription renews automatically every month, so when the regime applies to it we will comply, including:
- Key information before you subscribe, presented clearly and prominently.
- Reminder notices while your subscription continues, in the form and at the times the rules require (for monthly subscriptions, this is expected to mean periodic reminders, for example every six months). The reminders will tell you the price, the date of the next payment and how to cancel.
- An easy exit: you will be able to end your subscription in a single, straightforward step, online.
- A cooling-off period for your paid subscription, wherever the rules require one, with any refund due and any deduction the rules allow.
- Clear confirmation of cancellation, and of any refund due.
We will update these terms when the regime comes into force. If anything in these terms gives you fewer rights than the regime requires, the regime will apply instead.
[SOLICITOR NOTE: review against the final regulations and CMA guidance before January 2027, including: whether a no-payment-details trial falls outside the definition of a subscription contract; the initial cooling-off period and how it applies to digital content; reminder timing and content for monthly contracts; contract-exit methods; transitional rules for existing subscribers; and any changes to the 2013 Regulations.]
2.8 Price changes
- We may change the subscription price, for example because our costs change, or because Whizzly Ltd becomes VAT registered and has to charge VAT.
- We will give you at least [30] days’ notice by email before a new price applies to you. The new price will then apply from your first billing date after the notice period ends.
- If you do not want to pay the new price, you can cancel before it takes effect, and you will not be charged at the new price.
- Price changes never apply to a payment you have already made.
2.9 Failed payments
- If a payment fails, we (or Stripe on our behalf) will try to take it again over the next [7] days, and we will email you so you can update your payment details.
- If the payment still fails, we may pause your access until it is made. If it has not been made within [14] days of the original billing date, your subscription will end. We do not charge late-payment fees.
- You can restart your subscription at any time (a new free trial is not available).
2.10 Refunds and your consumer rights
- Your statutory rights: under the Consumer Rights Act 2015, the paid Service must be of satisfactory quality, fit for purpose and as described, and any related services must be provided with reasonable care and skill. If they are not, you may be entitled to a repair or replacement, or to a price reduction or refund. For example, if DESHANK does not work for a substantial part of a billing period because of a problem on our side, we will refund a fair proportion of that month’s fee. For detailed information, visit Citizens Advice (citizensadvice.org.uk).
- Refunds under sections 2.6 or 2.7 are made as described in those sections.
- Other refunds: apart from these, payments are not refundable for part-months after cancellation.
- Refunds are made to your original payment method, normally within 14 days of our agreeing them.
2.11 Changes to the Service and ending the subscription
- We may update the Service. We will not make changes that significantly reduce the main features you pay for without telling you in advance. If we do make such a change, you can cancel and receive a refund for any period you have paid for but not received.
- We may end your subscription for a good reason by giving you at least [30] days’ notice, and we will refund any period paid for but not yet received. If we stop offering DESHANK altogether, we will do the same.
- We may suspend or end your trial or subscription immediately if you seriously breach these terms (for example, by sharing your account against these terms or abusing free trials). Where we do, and the law allows, we will not refund the current billing period.
